Can I Give or Receive a Gift on Shabbos?
Topic: Whether giving or receiving a gift on Shabbos is permitted, and how to do it in a way that satisfies all opinions.
Background: Why Gifts Might Be a Problem on Shabbos
Chazal enacted the Gezeira of Mekach U'memkar in order to avoid business-like activity on Shabbos. One reason is that it can lead to Kesiva (writing), which is one of the 39 melachos forbidden on Shabbos.
The question today is whether giving a gift (or receiving one) falls under this Gezeira, or whether it is treated differently. We will be sourcing from the Gemara, the Bais Yosef, Mishna Berura, and from the sefer Commerce & Shabbos by R' Yosef Kushner.
Is an Acquisition/Kinyan Allowed on Shabbos or Not?
The Gemara in Eruvin 71a discusses a certain type of kinyan (acquisition) that is not allowed on Shabbos. Rashi explains the reason for not being allowed on Shabbos as its similarity to mekach u'memkar, business-like activity.
However, the Gemara in Beitzah 17a discusses a case of someone who forgot to make an Eruv Tavshilin (rendering himself unable to cook on Yom Tov for Shabbos). One option mentioned is giving a gift of his flour to someone else so that the other person can bake for him. The Gemara does not question whether the gift itself is permitted; rather, it discusses whether it needs to be done or not. From here we see that giving a gift can be permitted.
So how do we reconcile these two sources? Is it allowed or not?
Differentiating Between the Types of Kinyanim Needed for the Transfer of Ownership
Regarding giving a present, the Poskim explain that there are two types of transferring ownership:
- Business-like kinyanim that require an official act. Some transactions require a formal, business-type kinyan (for example, a kinyan sudar), and they are not simply passed hand-to-hand. In these cases, everyone agrees they should not be done on Shabbos. Common examples include selling real estate, selling a car, transferring stocks, and similar transactions.
- Simple hand-to-hand transfers (no formal business-like kinyan needed). These items are simply passed hand-to-hand, without a formal kinyan. Regarding this category, the transfer of ownership is permitted, but the criteria differs among Poskim.
Criteria for the Hand-to-Hand Transfer: Ran vs. Mordechai
The Bais Yosef (Orach Chaim, Hilchos Yom Tov, Siman 527) brings two opinions:
• The Ran: If it does not require a formal kinyan, a simple hand-to-hand gift is permitted, and no additional condition is required.
• The Mordechai (which is the psak of the Magen Avraham and Mishna Berura): Even hand-to-hand transfers are not automatically permitted. They must be: a) connected to Shabbos/Yom Tov needs, b) for a mitzva, or c) enhance the recipient’s enjoyment of Shabbos/Yom Tov.
He (the Mordechai) brings, for example, that on Sukkos people transfer their Daled Minim (lulav, esrog, hadassim, and aravos) from one person to another so each can fulfill the mitzva. That transfer is a gift, and it is permitted because it is for the mitzva.
Practical examples that enhance Shabbos/Yom Tov, and would be permitted according to both opinions, include:
• Bringing food, candy, or a fruit platter to a kiddush or Shalom Zachor
• Bringing a bottle of wine or platter to a host for a meal
• Giving jewelry or a watch to someone on Shabbos/Yom Tov (enhancing enjoyment)
However, if the gift has no connection to Shabbos/Yom Tov, is not for mitzva, and does not enhance enjoyment of the day—just a nice gift—then it would only be allowed according to the Ran, but not the Mordechai (and Magen Avraham/Mishna Berura).
How to Give a Hand-to-Hand Gift on Shabbos to Satisfy All Opinions
In such a case, if someone wants to satisfy all opinions and still give the item, there are two practical approaches:
Method #1 — You can still give it on Shabbos/Yom Tov, just delay the transfer of ownership until after Shabbos:
The giver and receiver should have in mind that the transfer of ownership should not take effect until after Shabbos is over.
Method #2 — Use a third party before Shabbos (Zachin L’adam):
Before Shabbos/Yom Tov starts, give the item to someone else who will acquire it on behalf of the recipient. Then on Shabbos, you are only handing over something the recipient already owns. When using a third party, be careful to use someone who is Jewish, over bar/bas mitzva, and not dependent on you. A wife or dependent children should not be used for this purpose.
Lenient Opinions for Hand-to-Hand Gifts Even Without the Above 2 Methods
Even though Mishna Berura is machmir like the Mordechai, there are strong opinions that allow relying on simple hand-to-hand gifting even without the added conditions. These include the Beis Meir, Rav Shlomo Zalman Auerbach, and ybd"l Rav Shlomo Miller.
Practical Summary
Business-like kinyanim that are not hand-to-hand and require formal transaction acts are not permitted on Shabbos or Yom Tov.
Hand-to-hand gifts are the main area of discussion: according to the Ran they are permitted; according to the Mordechai (and Magen Avraham/Mishna Berura) they are permitted when connected to Shabbos/Yom Tov needs, for a mitzva, or when they enhance pleasure of the day.
Best ways to satisfy all opinions:
(1) hand it over on Shabbos but both parties have in mind that ownership transfers after Shabbos, or
(2) arrange a third-party acquisition on behalf of the recipient before Shabbos.
If someone gives hand-to-hand even without the added conditions of the Mordechai, there are strong Poskim to rely on.
